What can I do about deficiencies in my new home?

All new homeowners are encouraged to review the contents of the Homeowner Information Package, which the builder must provide as part of the Pre-Delivery Inspection. Included in this package are the 30-Day, Year-End and Second-Year Warranty Claim Forms, which you must complete and send to Tarion on time if you experience problems after taking possession of your new home. You should send a copy of your completed statutory warranty form(s) to the builder, who will then have a specific period of time to repair or resolve the warranted items listed.

In many cases, claims are resolved directly by the builder. If the builder does not complete the repairs requested in your claim within a specific time period, you have 30 days to inform Tarion and request conciliation. The builder generally has 30 days from the date of that request to resolve the outstanding problems. If repairs are still not completed, Tarion is responsible for performing an inspection with you and the builder present and for issuing a decision regarding your claim. This decision may order the builder to resolve the problem or declare that your claim is not warrantable.
