Yes. If you disagree with a Tarion warranty decision, you can make an appeal within 15 days to the Licence Appeal Tribunal (LAT).
The LAT is an impartial and independent adjudicative body responsible for hearing appeals of decisions made by a number of regulatory bodies, including Tarion. The tribunal’s procedure provides homeowners with a timely and binding way to settle disputes about regulatory decisions. A one-member panel conducts the tribunal’s hearings in a court-like process. Tribunal members are appointed by Order-in-Council signed by the Lieutenant Governor of Ontario. The tribunal’s average turnaround time is about four months.
