Barrie Contractor Sentenced to 80 Days in Jail

Contractor with history of unfair business practices also receives 24 months probation

Mr. Corrado Indovino, a general contractor in Barrie, Ontario, operating as Eaglestone General Contactors – E.G.C. Roofing Division, was sentenced to 80 days in jail and 24 months probation on May 25, 2010 for violations of Ontario’s Consumer Protection Act.

Indovino was charged under the Consumer Protection Act after the Ministry of Consumer Services received complaints from four of his customers who entered into contracts and paid deposits totalling more than $28,000 for roof repairs to their homes. No roofing materials were delivered and no repair work was performed as contracted.

After serving his 80-day jail term, Indovino will complete a 24-month probation. During his jail term and probation, he will be prohibited from taking payments from customers until the work is done or the service promised is completed. The court also ordered Indovino to pay a total of $28,705 in restitution to the four customers.

Indovino had previously been charged under the Ministry of Consumer Services’ consumer protection legislation and had been sentenced to 75 days in jail in 2005.

QUICK FACTS

  • The Consumer Protection Act provides for fines of up to $250,000 for corporations and $50,000 for individuals convicted of offences. It also provides for jail terms of up to two years less a day for each offence. The act also empowers the court to order offenders to pay compensation or make restitution to victims.
